Job Description
Position Summary
Under the supervision of the Deputy General Counsel, serves as legal counsel to Elliot Health System and its affiliates, assisting with the delivery of legal services to all aspects of the organization, and coordinating closely with the corporate compliance, risk management, claims management, safety, security, emergency management and accreditation functions.
Primary Duties & Responsibilities
- Assists with the provision of a wide variety of legal services related to healthcare system operations, programs, facilities and personnel in an appropriate, accurate and timely manner. Provides legal services related to appropriate subject matters, including but not limited to: support to clinical, operational and business areas; corporate transactions (including but not limited to acquisitions, real estate transactions, contracts and agreements); labor and employment issues; medical staff issues (peer review, privileges, etc.); government agency regulations and licensure; government agency and law enforcement investigations and inquiries; internal investigations; intellectual property and licensing; and legal support to nonprofit and community benefit, tax and audit, insurance and claims management, security, safety, emergency management and related areas and departments.
- Assists with responding to legal and regulatory issues and questions pertaining to patient care, social work and similar areas, including but not limited to assistance with: advance directives, guardianships and probate matters, Involuntary Emergency Admissions, subpoenas, search warrants, patient consent issues, and other similar matters; includes on-call coverage as Legal Administrator On-Call for such issues, as a shared responsibility with the other attorneys, the Chief Compliance Officer, and Director of Risk Management on a rotating basis.
- Reviews, negotiates and revises complex contracts (including clinical services agreements, software licenses, consulting arrangements, physician employment contracts, etc.), and coordinates contract management.
- Drafts and reviews policies involving legal issues, including compliance with various state and federal laws and CMS Conditions of Participation.
- Coordinates closely with and provides legal support to corporate compliance, particularly relating to: billing and coding compliance; government and payer audits; whistleblower protections and compliance hotline; healthcare fraud and abuse laws including the Stark Law, the Anti-Kickback Statute, the False Claims Act, HIPAA and HITECH.
- Assists with the department’s budget and develops department strategic plans (based on organization strategic initiatives) and fiscal goals.
- Assists with liaison relationships with outside counsel and other consultants as required.
- Assists with the provision of legal educational programs and training for management and appropriate personnel.
- Provides input on committees in areas related to legal aspects of healthcare system operations.
- Oversees and manages contract review staff and processes.
- Assists with oversight and management of the paralegal.
- Serves on Ethics Committees, as needed.
Position Qualifications
Education: Juris Doctorate from an accredited law school required
Licensure : Admitted to practice law in at least one state and eligible for admission to the New Hampshire Bar
Experience : Minimum of seven years' experience as a practicing attorney, with demonstrated interest in health law and relevant experience (such as health care, litigation, regulatory, labor and employment and/or corporate) required.
Knowledge : Extensive knowledge of state and federal health care fraud and abuse laws, particularly the Stark law and Anti-Kickback statute, and familiarity with other health care laws and regulations. Extensive knowledge in the areas of contracts, corporate and commercial law, and health care and hospital law
