Trade Compliance Leader

This position is responsible for the continued development and maintenance of Garrett’s China & Japan import-export compliance program. The Trade Compliance Leader will provide leadership and expertise in ensuring China & Japan trade compliance for Garrett Motion.

This role has direct responsibility for overseeing China & Japan import and export, ensuring compliance with China & Japan import and export control laws, as well as free trade and duties eligibility for various programs, providing a full coverage of Company's reputation against penalties associated with non-compliance: sanctions, fines, loss of import or export privileges, disruptions on deliveries to customers and plants.

The Trade Compliance Leader works cross functionally with Garrett China & Japan business and operations leaders to broaden awareness of trade compliance, establishing and maintaining the strategic direction of the function in alignment with the changing regulatory environment. This is accomplished by interfacing directly with global trade compliance teams and various functional area leaders to drive process improvements implementation in all areas of import-export compliance.

Covering all import export activities of China & Japan Sites with a total import export value $. Managing a duty cost budget, liability of estimated $(excluding penalties and interest that can be applied for negligence in customs compliance and/or gross negligence) and supervising various duty Trade programs including Free trade agreements.

Position is responsible to lead all customs audits that may be triggered in China & Japan, and for monitoring key industry developments, legislative, and regulatory changes affecting Garrett business. Position leads with business unit management and other functional area managers to investigate possible customs and export control compliance violations.

Position will report to the Asia Trade Compliance Manager, and interface with Garrett China & Japan management, Global Trade Compliance teams, Customs and or others Trade authorities, customs brokers, freight forwarders, internal/external legal counsel, customers, suppliers.

Position will also provide supervisory support, training, to China & Japan entity on import-export compliance matters, and will also assist the Integrated Supply Chain functions with all departmental goals and objectives.

Key Responsibilities

1. Responsible for Trade Compliance in China & Japan
2. Lead and support Government, customs authorities and internal audits;
3. Conduct Customs compliance on site review/self-assessment, define corrective actions, and lead execution on compliance improvement plan and support sites with implementation;
4. Responsible for import /export Clearance Cycle Time and other Compliance KPI for the region
5. Report to China & Japan Metrics, new regulations, trend, risks, and opportunities
6. Manage brokers with Global function: Broker selection, contract, e-auction, implement and supervise score card/KPI, contractual agreements and SOP;
7. Management of all import-export operations in the country;
8. Monitor export control laws, ensure compliance of all export control requirements
9. Set up an export control process with cross functions and lead execution
10. Ensure and audit export control compliance including screening of Denied Party List/Sanctioned Party List programs through GTS system;
11. Implement controls and supervise determination and maintenance of Country of origin, Tariff Classification and Valuation (including TP, royalties, tooling, engineering etc) with the different functions;
12. Coordinate with various functional areas to minimize risks/maximize opportunities, including but not limited to Legal, Tax, Supply Chain, Supply Base, Finance; engineering, sales,
13. Monitoring key industry developments, legislative and regulatory changes affecting Garrett;
14. Support Global Trade Compliance function with on site reviews;
15. Deliver AOP, STRAP duty costs , risks and opportunities, cost and risk mitigation solutions, duty saving/optimization projects initiatives;
16. Identify and support import duty savings;
17. Support landed cost analysis;
18. Support Incoterms buy/sell decisions;
19. Support cross functional projects (Sales, Supply Base, Supply Chain, and Finance) with duty impact analyses and winning opportunities in case of source changes or new Supply Chain flows;
20. Formal communication to customs authorities: customs request for information; Controls, post or exante, Audits etc ....
21. Verify and ensure proper import and export recordkeeping as per local law requirements and Garrett Internal Policy, and conduct post entry audits of import and export records;
22. Monitor and support China & Japan import and export matters while ensuring best practices programs consistent with China & Japan customs regulations and Garrett import-export policies and guidelines;
23. Manage local broker(s) with focus on Commodity Codes. Monitor performance, address local service issues, ensure the development of standard operating procedures; ensure development and execution of entry audits and billing;
24. Classify China Japan part n° and Maintain China Japan customs classification database and classification sheet, ensure internal approval via Global Trade functions, and Global Tariff committee;
25. Responsible for the qualification preference process and administer preference for China exports as per Free trade agreement rules: preference management, issue preference declarations with supportive evidences and calculations, monitor compliance of preference calculation and process, supervise Supplier Declarations for vendors and due diligence, support Purchasing in annual dunning process and new and existing vendors;
26. Create and deliver import and export training to cross functions staff in China & Japan
27. Deliver periodic Export Control Training to cross functions,
28. Deliver awareness session to Functional groups: Finance, Engineering, Supply Base, Tax, Logistics, Sales;

Qualifications and Skill Required

1. Bachelor Degree in International Trade or customs law
2. A minimum of 5 years of import-export compliance experience required
3. Experienced in drafting formal Customs correspondence.
4. Technical knowledge of Customs and export controls regulations, incoterms
5. Technical knowledge of Free Trade Agreement Landscape
6. Technical knowledge of tariff classification
7. Skilled with special Customs programs
