Basic Purpose

Positions in this job family co nduct legal research and pro vide legal representation and advice to clients in government-related areas of expertise (e.g., oil and gas, public utility, and transportation, regulatory co mpliance, rulemaking, employment/labor, ethics, health and human services, open re co rds, co nstitutional law or other areas of law as may be applicable).

Typical Functions

  • Prepares or presents letters, memoranda of law, briefs, co ntracts, pleadings, motions, orders, co nsent, and other relevant or related documents and leadings. This may include preparing or presenting appeals to district, civil, supreme, or other co urt pro ceedings in writing or orally, to Boards and Co mmissions and their members, and other co urt pro ceedings as directed.
  • Reviews, edits, and ap pro ves lit igation filings when ap pro priate. This may be for lower-level att orneys, or litigatio n that is significant or co mplex.
  • Mentors or oversees lower-level staff and pro jects within an assigned area in an effective and pro fessional manner, reviews and pro vides guidance of cases including cases involving litigation; may re co mmend or pro vide training, guidance, motivation, and support of staff .
  • Participates or assists in the res olution of inmate co mplaints and appeals through the State's administrative pro cess, state and federal co urts. This may include, but is not limited to, Co mplaints or allegations by current and former inmates and offenders regarding discipline, co nditions of co nfinement, habeas c o rp us, sentencing and registration requir eme nts.
  • Participates or assists in the resolution of employee co mplaints, disciplinary actions, and appeals through the State's administrative pro cess, other regulatory bodies, or co urt appeals when required. This may include, but not limited to, co mplaints or all egations by employees regarding discrimination, wage and hour disputes, employee discipline, and unemployment.
  • Co nducts or assis ts in the enfor ce ment o f agency policies, statutes and rules including action taken against staff or inmates for violations of rules, policies or statutes.
  • A dvises agency staff on rules, laws, policies and pro cedures .
  • Prepares or presents letters, memoranda of law, briefs, co ntracts, pleadings, motions, orders, co nsent, and other relevant or related documents and pleadings. This may include preparing or presenting appeals to district, civil, supreme co urt, or other pro ceedings in writing or orally, to Boards and Co mmissions and their members, and other co urt pro ceedings as directed.
  • Co nducts depositions and dis co very .
  • Drafts, reviews, edits, and ap pro ves litigation filings when ap pro priate.
  • Mentors or oversees lower-level administrative staff and pro jects within an assigned area in an effective and pro fessional manner .
  • Reviews and responds to open re co rds requests .

Level Descriptor

This is the career level of the job family, where incumbents are largely responsi ble for per forming a full range of pro fessional legal activities or at a full performance l evel. Ma y pro vide training or assistance to lower-level employees. Assignments are prescribed, but the methods are not typically reviewed nor co ntrolled while the work is in pro gress.

Knowledge, Skills, Abilities, and Co mpetencies

Knowledge, Skills, and Abilities required at this level include knowledge of applicable state and federal laws; applicable regulations; co nstitut ional law and the Oklahoma Co nstitution; agency policies and pro cedures; trial and hearing pro cedures; rules of evidence; methods and techniques for co nducting legal research and writing.

Skills required include critical thinking; co nducting legal research and written and oral co mmunication; M icrosoft Office – Outlook, Word, PowerPoint, and Excel; attention to detail; sound judg ment and decision making .

Abilities required inclu de pre senting statements of fact and law; clearly and logically articulate position in written and oral form; analyze, interpret, and apply various laws, rules, regulations, agency policies, and pro cedures; direct and/or perform independent and difficult research, analyzing, appraising, and applying legal principles and precedents to difficult legal or factual pro blems; co nduct legal research on Westlaw, Lexis/Nexis, Fastcase , the Oklahoma State Co urt Network, and printed or internet-based legal resources; meet timelines while following the Oklahoma statutes; represent the agency in a pro fessional manner; train lower-level employees, pro vide leadership in the absences of the agency General Co unsel.

Education and Experience

Education and Experience requirements at this level co nsist of a Juris Doctor degree from an accredited law school, a license to practice law in State of Oklahoma; an active membership of the Oklahoma Bar Association and two years of legal experience or adjudicative experience.

Special Requirements

  • Admitted to practice law in Oklahoma and preferably federal co urts
  • Two years of experience, preferably as a public sector attorney
  • Must abide by the Oklahoma Rules of Pro fessional Co nduct

Some agencies may require the incumbent to function or co mply with

  • Oklahoma Statutes, in particular Title 68: Revenue and Taxation, and the Oklahoma Administrative Co de, Title 710: Oklahoma Tax Co mmission.

  • Federal tax information (FTI) received by the agency must be pro tected as directed by 26 U.S.C. § 6103.
